TERMS AND CONDITIONS:

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR TO PARTICIPATE IN THE BINNY’S BEVERAGE DEPOT (“SPONSOR”) DIGITAL DRAWING (THE “DRAWING”). YOU MAY ENTER THE DRAWING FOR A CHANCE TO PURCHASE AN ALLOCATED BOTTLE OF WHISKEY AT A BINNY’S BEVERAGE DEPOT LOCATION WITHIN THE STATE OF ILLINOIS. THIS PROMOTION IS VOID WHERE PROHIBITED BY LAW. WINNING A CHANCE TO PURCHASE DOES NOT GUARANTEE PICK UP LOCATION AVAILABILITY OR PRODUCT AVAILABILITY. BY ENTERING THE DRAWING, YOU AGREE TO THESE OFFICIAL RULES. READ THESE RULES CAREFULLY BEFORE ENTERING.  BY ENTERING, YOU AGREE TO WAIVE ANY RIGHT TO CLAIM ANY AMBIGUITY OR ERROR IN THESE OFFICIAL RULES.  

  

1. ELIGIBILITY: This Drawing is open to legal residents of Illinois, Indiana, Iowa or Wisconsin who are 21 years of age or older at the time they enter the Drawing. Employees of Binny’s Beverage Depot are ineligible to enter the Drawing. Entrants may be required to provide proof of Drawing eligibility upon their Drawing selection. Eligibility determinations will be made by Sponsor. Sponsor reserves the right to disqualify entrants who violate these Official Rules or interfere with this Drawing in any manner.  
   
   
2. HOW TO ENTER: Beginning November 14th, 2024, Entrants may enter the Drawing by enrolling through the Binny’s mobile app. Drawing winners will have a chance to purchase one bottle of limited-edition whiskey. Entrants must complete all required fields, check any CAPTCHA security box(es) (if applicable), and timely submit the entry in order to be Drawing eligible and entered. Incomplete or unsubmitted entries will not be accepted. Entrants will be required to sign into the app using their Binny's Card account, and then opt into the drawing. Pick up locations are not guaranteed, and entrants may not be assigned their top bottle choice.  

   Only one (1) entry per Binny’s Card will be accepted and an individual may only enter the digital drawing once. If multiple names are associated with a Binny’s card and another entry is requested, a new Binny’s card must be opened in the individual’s name. Multiple entrants are not permitted to share the same e-mail address. Any attempt by any entrant to obtain more than one (1) entry by using multiple/different emails, addresses, identities, registrations or logins, or any other methods will void that entrant’s submissions, and that entrant may be disqualified from the drawing. No entries or information related to entries will be returned. Use of any robotic, automatic, programmed or similar entry method will void all entries and result in disqualification.  If an eligible entrant does not have access to a mobile phone, they can email comments@binnys.com with their name, email, phone number, and Binny’s Card # to be entered into the drawing.  

3. DRAWING(S): Sponsors will conduct a drawing on or about December 1st, 2024 among all eligible entries received. The number of winning entries selected will be determined based on the number of limited bottles available for sale. Sponsors will notify potential winners by email/app notification within 2 days of the drawing. Sponsor is not required to notify a potential prize winner more than once. Failure of a potential prize winner to claim his/her prize within one week of winning will result in the forfeiture of the opportunity to buy the limited bottle and an alternate may be drawn from all remaining eligible entries in Sponsor’s sole discretion.  Limit one prize per winning entrant. Odds of winning depend upon the number of eligible entries received and the eligible bottles available for sale. Eligible prize bottles will be determined at the sole discretion of the Sponsor. Individuals suspected of purchasing bottles for resale will be removed from the entrant pool at the Sponsor's discretion. Entrants with greater rewards card activity will have a higher likelihood of being selected. Purchase history of allocated bottles will not increase the likelihood of being chosen as a drawing winner. 
   
   
4. PRIZE: Each winning entrant of the Drawing will be entitled to purchase 1 bottle of limited product. A Prize Winner must purchase their bottle within a week of winning or his/her inaction will constitute forfeiture of the Prize. There is no monetary value to the Prize. No substitutions or cash redemption of the Prize is permitted. The Prize, and any item purchased by a winner of the Prize through the Drawing, is not assignable or transferable and may not be resold. Winners may purchase their bottle by presenting his/her winning Drawing code, showing valid government issued identification, and purchase the bottle(s) by means of a purchase method approved by Sponsor (including any applicable tax(es)). The Winner’s valid government ID must match the information as submitted for the Drawing entry. Bottles will be sold on a first come first served basis and Gold Standard Enterprises, Inc, will make all reasonable attempts to ensure that winners receive their designated bottles. In the event that Binny’s is unable to offer for sale the bottle designated in the drawing, a comparable bottle will be made available at the Company’s discretion.
   
   
5. GENERAL RULES: VOID WHERE PROHIBITED BY LAW. NO PURCHASE NECESSARY TO ENTER OR WIN. Sponsor’s decisions with respect to all aspects of the drawing are final and binding. A prize winner may not substitute or transfer any prize. All federal, state and local laws and regulations apply. Any notifications returned to Sponsors as undeliverable will result in the entrant being disqualified from the Drawing, and Sponsors will select an alternate entrant as the prize winner if time allows. Sponsor reserves the right at provision.  
   
   
6. LIMITATION OF LIABILITY: By entering the Drawing or accepting a prize, entrant and/or the prize winner consents to the Sponsors and their agents’ use of the winner's name, information provided to register, and likeness for purposes of advertising and trade in perpetuity without further compensation, unless prohibited by law. By entering the Drawing or accepting a prize, the Drawing entrant and/or prize winner agrees to defend, indemnify, and hold harmless Gold Standard Enterprises, Inc. and their respective owners, subsidiaries, affiliates, partners, directors, officers, employees and assigns, against any and all claims, liabilities, debts, obligations, costs, fees, expenses, actions and causes of action arising out of or in any way related to the Drawing; these Official Rules; any Drawing entry; the negligence of the Sponsors; the acceptance, possession, misuse or use of any prize; and any participation in the Drawing. Winners assume all liability for any injury or damage caused or claimed to be caused by participation in this promotion or use or redemption of any prize and expressly agrees to forever waive, release, discharge, and covenant not to sue Sponsor or its owners, subsidiaries, affiliates, partners, directors, officers, employees and assigns for any cause of action arising out of or in any way related to the Drawing; these Official Rules; any Drawing entry; the negligence of Sponsor; the acceptance, possession, misuse or use of any prize; and any participation in the Drawing. By entering the Drawing or accepting a prize, Drawing entrant and/or prize winner represents and warrants that he or she owns and/or has the authority to release the claims stated above. As a condition to participating in this Drawing, each entrant agrees that (a) any and all disputes that cannot be resolved between the parties, and all causes of action arising out of or in connection with this Drawing shall be resolved individually, without resort to any form of class action, exclusively before a court located in Illinois having competent jurisdiction, which court shall apply the laws of the State of Illinois, without regard to the conflicts of law principles thereof; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Drawing, but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out of pocket expenses, and any and all rights to have damages multiplied or otherwise increased.  

   
   By participating in this promotion, entrants agree to be bound by the Official Rules and the decisions of the Sponsor. Sponsors reserve the right to prohibit an individual from participating in this Drawing if Sponsors suspect the entrant has engaged in illegal activity (including but not limited to reselling of product), or committed fraud or tampering, directly or through others, with respect to this Drawing or any other promotion of Sponsors, or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules. Sponsors are not responsible for late, lost, damaged, incomplete, illegible, postage due, or misdirected mail, incorrect announcements of any kind, or Internet, e-mail, technical, hardware, software, or transmission failures of any kind. Proof that an entrant has submitted an entry will not be deemed proof that Sponsor has received such entry. Any use of robotic, automatic, programmed or the like methods of participation will void all such submissions by such methods. Sponsors are not responsible for any typographical or other error in the printing, the offering or the announcement of any prizes or in the administration of the promotion or contest.
